Here's a reply (pro-forma no doubt) I got from Mayor Rob Ford's office on this:
Thank you for your email about the incident in Yonge Dundas Square reported in the Toronto Sun.
After a thorough investigation, members of the Toronto Police Service are entitled to exercise their discretion in deciding whether to lay charges or not under the rules set out in the Criminal Code of Canada.
This individual, like all members of the public, is entitled to pursue the matter in the criminal courts through what is known as a private information. The private information process and rules are governed by the provincial Ministry of the Attorney General.
Thank you again for taking the time to share your thoughts and concerns.

Charges are at the "discretion" of the beat cop. Next step "criminal court"?! Nothing in between? Geez! Anyway, let's hope Menzies pushes it further.
Indeed I also hope that Menzies pushes it further and does not let them off the hook. Sorry but assault is assualt and is not at the discretion of the police officer.
