Obama SC nominee Sotomayor - Part III

Confirmation hearings on Sonia ["wise Latina"] Sotomayor’s US Supreme Court nomination continue apace with, unlike SC appointments in Canuckistan, lots and lots of commentary from all quarters.

Why should Canadians care? Lorne Gunter:

... two reasons: First, American judicial trends -- especially the liberal ones -- have a way of creeping into our own legal system. An activist U. S. high court would encourage our own judges to be even more activist than they already are.

... mostly I think we should be fascinated with her confirmation for the insight it is providing into liberal legalthink [in particular liberal double standards] ... If Sonia Sotomayor were a conservative white male, she likely would not be confirmed as a justice on the U. S. Supreme Court ...

A liberal law professor:

I was completely disgusted by Judge Sotomayor's testimony today. If she was not perjuring herself, she is intellectually unqualified to be on the Supreme Court. If she was perjuring herself, she is morally unqualified.

Barack Obama’s email [Yes, I get email from POTUS]:

It's important for these hearings to be about Judge Sotomayor's own record and her capacity for the job — not any political back and forth that some in Washington may use to distract you.
[Translation: "Don’t listen to the critics." Actually, the nomination hearings involving "political back and forth" is the essence of the process, an intensely political one - hardly a mere "distraction".]

Lawyers make their living - justify their very existence - in how well they use 'words'.

Because, like it or not, our laws are written in words, our legal concepts and principles (not principals) are expressed in words.

For a lawyer to not be able to use even basic words which express not so basic legal concepts... that 'ought to' make such a lawyer 'unemployable'!

For such a lawyer to be appointed a judge - that is a travesty of justice in itself.

For such a lawyer to be nominated for the US supreme court: that is a SCANDAL!!!!

Yet, I have the sinking feeling that she WILL be confirmed: she has a history of playing the 'I am oppressed because of my race' card..... Those doing the review will be so afraid of being smeared as 'racists' that they will take the cowardly way and confirm the demonstrably unqualified person into a position of real power....

Sickening!

Face it, it's an affirmative action pick. Just like Clarence Thomas.

Neither Thomas or Sotomayor deserves to be on the Supreme Court and if the process were truly colour blind, they wouldn't be.

In the bigger picture, Sotomayor's appointment is meaningless. She replaces a not-so-dynamic or intellectually rigourous Souter. She will vote the same way and for the same reasons. The nonsense that she will be babbling will just be filler to fluff out concurring opinions with the others of the current minority on the Court.

Thankfully, none of the majority on the Court look too fragile and should last until after January 2013.
